Risk Assessment
Regulatory Reform (Fire Safety) Order 2005
From October 2006 there were a number of significant changes to Fire Safety Legislation and all emphasis rests with you the ‘Responsible Person’.
How will you know if you will be affected by the Law change?
- Are you responsible for business premises?
- Are you an employer?
- Self-employed with business premises?
- A charity or voluntary organisation?
- A contractor with a degree of control over any premises?
If you answered YES to any of the above questions then you will need to act now.
As the ‘Responsible Person’ you must carry out or appoint a ‘competent person’ to carry out a suitable and sufficient fire risk assessment. This ‘competent person’ must understand fire safety legislation, training, experience and knowledge of fire safety. Understand fire hazards, the development of fire and the knowledge and experience in carrying out fire risk assessments.
Failure to comply may result in fines in excess of £2000 and or a prison sentence of up to 2 years.
Fire Safety Legislation
The Regulatory Reform (Fire Safety) Order 2005 (FSO) came into effect in October 2006 and replaced over 70 separate pieces of fire safety law.
The FSO applies to all non-domestic premises in England and Wales, including the common parts of blocks of flats and houses in multiple occupation (HMOs).
The law applies to you if you are:
• responsible for business premises
• an employer or self-employed with business premises
• responsible for a part of a dwelling where that part is solely used for business purposes
• a charity or voluntary organisation
• a contractor with a degree of control over any premises
• providing accommodation for paying guests
The FSO states that if you fall into one of the above categories, by law, you must prepare a Fire Risk Assessment.
A Fire Risk Assessment is an organised and methodical look at your premises, the activities carried on there, and the likelihood that a fire could start and cause harm to those in and around the premises.
The aims of the Fire Risk Assessment are:
• To identify the fire hazards
• To reduce the risk of those hazards causing harm to as low as reasonably practicable
• To decide what physical fire precautions and management arrangements are necessary to ensure the safety of people in your premises if a fire does start.
